Returns and Refunds Policy

1. Overview

This policy outlines the refund terms for digital services provided by Bochie LTD (trading as Bochie Creative Solutions). Due to the nature of our custom software development and digital services, refunds are handled on a milestone basis.

2. Refundable Services

Initial Deposits

Initial project deposits are refundable if no work has commenced. Once discovery or development work begins, deposits become non-refundable but are applied to the project cost.

Milestone-Based Refunds

For ongoing projects, refunds are calculated based on completed milestones:

  • Completed milestones are non-refundable
  • Work in progress is charged proportionally
  • Future milestones may be refunded if no work has started

3. Non-Refundable Services

The following services are non-refundable once delivered:

  • Completed design work and deliverables
  • Deployed software and applications
  • Consultation and discovery sessions
  • Third-party service setup and configuration
  • Training and documentation
  • Support and maintenance services already provided

4. Refund Eligibility

Refunds may be considered in the following circumstances:

  • Services were not delivered as specified in the contract
  • Technical impossibility prevents project completion
  • Mutual agreement to terminate the project
  • Breach of contract by Bochie Creative Solutions

Refunds will NOT be provided for:

  • Change of mind or business direction
  • Dissatisfaction with delivered work that meets specifications
  • Client-caused delays or scope changes
  • Third-party service limitations or changes

5. Refund Process

To request a refund:

  1. Contact us in writing with your refund request and reason
  2. Provide relevant project details and documentation
  3. Allow up to 14 business days for review
  4. If approved, refunds will be processed within 30 days
  5. Refunds will be issued to the original payment method

6. Partial Refunds

In cases where work has been partially completed, refunds will be calculated based on the percentage of work completed and the value delivered. This assessment will consider:

  • Time invested in the project
  • Deliverables completed and provided
  • Resources allocated to the project
  • Third-party costs incurred

7. Dispute Resolution

If you disagree with our refund decision, we encourage you to contact us to discuss the matter further. We are committed to finding fair solutions for all parties.

If a resolution cannot be reached, disputes may be escalated to mediation or resolved through the courts of Kenya as specified in our Terms of Service.

8. Subscription Services

For ongoing support and maintenance services:

  • Monthly subscriptions can be cancelled with 30 days notice
  • No refunds for partial months of service
  • Services continue until the end of the paid period
  • Annual subscriptions may be refunded on a pro-rata basis in exceptional circumstances
